Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Promises mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download or use the App. These Terms constitute a legally binding agreement between you and Kyox LLC ("we," "us," or "our").

2. Description of Service

Promises is a Bible promises application that delivers daily curated Bible verses, guided prayer templates, and faith-building tools across multiple categories. The App is available on iOS and Android devices and offers both free and premium subscription tiers.

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices that you own or control, in accordance with the usage rules set forth in the Apple Media Services Terms and Conditions or Google Play Terms of Service, as applicable. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time, except as permitted through Apple's Family Sharing or volume purchasing programs.

4. Subscriptions and Billing

4.1 Premium Subscription

Premium features are available through auto-renewable subscriptions. Current pricing is displayed in the App before purchase. Payment is charged to your Apple ID account or Google Play account at confirmation of purchase.

4.2 Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

4.3 Free Trial

Promises offers a 3-day free trial for new subscribers. During the trial, you have full access to all Promises Premium features. Your subscription will automatically convert to a paid subscription at the end of the 3-day trial period unless you cancel at least 24 hours before the trial ends. The price of the paid subscription will be displayed before you start the trial and at the time of conversion.

You can cancel at any time during the trial — including immediately after starting it — and continue to enjoy Premium access until the trial period expires, after which your subscription will not renew and no charge will be made.

4.4 Managing and Cancelling Subscriptions

You may manage or cancel your subscription at any time through your device settings:

Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5. Content and Intellectual Property

Bible verses included in the App are sourced from publicly available translations. Prayer templates, app design, code, graphics, icons, and all other creative assets are the original property of Kyox LLC or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

6. Focus Feature (App Lock)

Promises includes an optional feature called Focus that helps you build intentional phone-use habits. When enabled, Focus reminds you to pause and read a short Bible verse and prayer before opening apps you have personally selected.

Focus is off by default. You must explicitly enable it and select which apps to include. You can disable Focus, change your selected apps, or revoke the underlying permissions at any time from Settings → Focus inside the App.

On Android, Focus uses the Android Accessibility Service to detect when a selected app is launched. The service is used solely for this purpose and does not read screen content, capture keystrokes, record media, or transmit any data off your device.

On iOS, when supported, Focus uses Apple's FamilyControls, ManagedSettings, and DeviceActivity frameworks to provide the same behavior. Selected app tokens are stored on your device and are not transmitted to our servers.

Full details on what data Focus accesses (and what it does not) are described in our Privacy Policy under section 7.

Focus is a wellness feature intended to support your personal spiritual practice. It is not a parental-control tool, and Kyox LLC makes no representation that Focus will prevent any specific use of your device or any third-party app. You remain solely responsible for your use of the App and your device.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The spiritual content provided is for personal devotional use only and does not constitute professional counseling or advice.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Kyox LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, regardless of whether we have been advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination, your license to use the App will immediately cease. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law shall survive termination.

12. Apple App Store Additional Terms

The following terms apply when you download or use the App through the Apple App Store:

12.1 Acknowledgement

You acknowledge that these Terms are between you and Kyox LLC only, and not with Apple Inc. ("Apple"). Kyox LLC, not Apple, is solely responsible for the App and its content. These Terms may not conflict with the Apple Media Services Terms and Conditions.

12.2 Scope of License

The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

12.3 Maintenance and Support

Kyox LLC is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

12.4 Warranty

Kyox LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Kyox LLC.

12.5 Product Claims

You acknowledge that Kyox LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

12.6 Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Kyox LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

12.7 Legal Compliance

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

12.9 Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).

12.10 Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Google Play Additional Terms

When you download or use the App through Google Play, you also agree to the Google Play Terms of Service. In the event of any conflict between these Terms and the Google Play Terms of Service, the Google Play Terms of Service shall prevail with respect to your use of the Google Play Store.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved in the courts of South Africa.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of this page and, where practicable, by providing notice within the App. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
